I, Sam, aged 25 years, S/o
...................., residing at ............... House, ........................, Ernakulam District,Pin-682504 do hereby solemnly affirm and state as
follows:
1.
I am the Petitioner in the above Writ Petition. I am conversant with the
facts of the case. I am swearing this affidavit on behalf of other petitioners in the above case.
2.
The above Writ Petition.is against decree
dated 07.11.2004 in O.S. No. /2000 of the 2nd Additional Sub
Court, Ernakulam. .....................................................................................................................................
3. It is submitted that the decree is bad in
law and liable to be set aside. The
appellant is not a partner of Pattasseril Cement Marketing against which the
relief in the suit has been sought for.
No suit therefore can be maintained against me by the respondent and not
liable for the suit claim.
4. The
respondent has filed E.P.No.292/2005 for execution of a decree impugned in the
above Writ Petition. The E.P is not posted
4/8/2000 for sale of property of the appellant for recovery of the decree
amount. If the sale takes place I will
be put irreparable injury and hardship.
There is already an attachment of three items of properties at the stage
of the suit itself. Therefore the suit
claim already secured pending disposal of the above appeal.
It is hence essential
and expedient in the interest of justice that this Hon’ble
Court may be pleased to stay all further proceedings in the E.P.No.292/2005 on
the file of the Principle Sub Court, Ernakulam in O.S.No.51/200 pending
disposal of above appeal.
All the above facts are true and correct to the
best of my knowledge, belief and information.
